Abstract
Teaching sectorization is an acquired labor law that was implemented in the legal system of the Regulation of the Organic Law of Intercultural Education in order to guarantee access to relocation of Ecuadorian teachers who have met previous requirements, identified priorities, available vacant posts, right professional profile, same career as the available permanent designation, educational level asked, teaching experience and order of priorities according to the Ministry of Education. The Ministry of Education, in its Regulation of the Organic Law of Intercultural Education (OLIE), presents multiple legal vacuums and negligence in the interpretation of valid legal regulations by the administrative officials of the school districts and zonal education departments, in which are evident some frequent irregularities publicly broadcasted by the Ecuadorian Ministry of Education that denounce the crimes of political corruption, influence peddling and bribery which violate the labor law of teaching sectorization. This research work aims to review the national educational legislation to determine the scope of defense and legal protection based on Labor Rights in the educational sectorization of the Ecuadorian Ministry of Education teachers focused on the system and labor relations through a documentary, bibliographical, historical, logical, inductive and deductive investigation with the objective of carrying out a precise, critical and reflective legal analysis of these current problems.
